The decision to deport Terraform Labs founder Do Kwon to South Korea has been deemed illegal by the Prosecutor General’s Office of Montenegro. The office stated that the Minister of Justice can only make a decision on a simplified procedure for extradition to the Republic of Korea.

The Supreme Court of Montenegro is said to have exceeded its authority by shortening the extradition hearing and granting permission without considering the prosecutor’s office’s arguments, which violates Montenegro’s legislation. The Prosecutor General’s Office has proposed to the Supreme Court to reconsider the request and cancel the decision to extradite Do Kwon.

The case of extraditing Do Kwon has undergone several legal proceedings. Initially approved by the Supreme Court of Montenegro in November 2023, the decision was later transferred to the Ministry of Justice. Following an appeal by the defendant’s lawyers, a higher court overturned the verdict. Subsequently, there were reports of extradition to U.S. authorities, which were successfully appealed by Do Kwon’s defense.

In early March, the Supreme Court of Montenegro approved the extradition of Do Kwon to South Korea, facilitating a simplified process for handing over the accused to the country’s authorities for prosecution. The U.S. authorities, who have also brought charges against Do Kwon, plan to appeal the decision in their favor, citing allegations of fraud causing billions in losses.

Montenegro’s Prosecutor General’s Office is urging the Supreme Court to reconsider the decision and potentially keep Do Kwon in Montenegro indefinitely. The legal battle surrounding the extradition of Do Kwon continues, with ongoing developments in the case.
